10.1 Review Letter from the Alameda County Office of Education Regarding the 2019-20 Second Interim Budget Report

Purpose: The CBO will discuss and review the letter from the Alameda County Office of Education (ACOE) regarding the Newark Unified School District (NUSD) 2019-20 Second Interim Budget Report.
Background: The Governing Board approved a Qualified Certification of NUSD's Second Interim Financial Report on March 19, 2020.
In accordance with Education Code (EC) Section 42131, ACOE reviewed the Second Interim Budget Report based on standards and criteria for fiscal stability adopted by the State Board of Education pursuant to EC Section 33127.
Based on ACOE's review and analysis, the Second Interim Budget Report approved by NUSD's Governing Board on March 19, 2020 accurately reflects the financial status of the District. ACOE therefore concurred with the District's QUALIFIED certification.
Due to the QUALIFIED certification of NUSD's Second Interim Budget Report, EC Section 42127.6 stipulates that the Alameda County Superintendent of Schools shall take "all actions that are necessary to ensure that the district meets its financial obligations." Therefore, ACOE requests the following be submitted to their office no later than June 1, 2020: A financial statement that projects the District's fund and cash balances through June 30, 2020, for the period ending April 30, 2020. This report, known as the Third Interim Budget Report, is not required to be self-certified as "positive," "qualified," or "negative." A detailed list of Board-approved budget balancing solutions required for 2020-21 in order to maintain fiscal solvency. A written update on the progress of the District Advisory Committee that is gathering facts on possible school consolidations or closures in NUSD.
The following addresses the State's economic outlook due to the COVID-19 pandemic which was included in the ACOE letter:
Economic Outlook Over the past few weeks, it has become apparent that the Coronavirus (COVID-19) Pandemic will have a profound impact on the State's general fund revenues, which ultimately impacts K-12 financial health. This is a sudden shift to a very different economic environment compared to the estimates in the proposed State budget announced in January 2020. In times of uncertain revenue streams, it is important to develop multiple scenarios that could reasonably affect the school district's finances. Each scenario demands a different set of corresponding actions necessary to balance revenues and sustain adequate reserve levels. Some of the best practices listed below were provided for the district's consideration as we navigate during these uncertain times: Using the Second Interim Budget Report, develop scenarios with different levels of Cost of Living Adjustment (COLA) below 2.29%. One of the scenarios should be a 0% COLA in fiscal years 2020-21 and 2021-22 Based upon budget scenarios above, review the anticipated cash flow and its impact to monthly cash balances. Closely monitor cash in each of the District's funds, ensuring healthy cash balances are maintained. Additionally, examine the impact of a possible cash deferral of the June 2020 apportionment to July 2020, as well as during the 2020-21 budget year. While we are waiting for the May Revision from the Governor The Governor is expected to announce the May Revision to the proposed budget for 2020-21, which usually incorporates the result of income tax collection during the tax filing of April 15. Due to the extension of income tax filing to July 15, 2020, the May Revision may not necessarily paint a true picture of the 2020-21 budget. We may remain in uncertain times for an extended period, in that, while we expect an on-time budget, we also anticipate the legislature will revisit the budget in August once the revenue picture is clearer.

1a. Student Achievement
Purpose: To approve a temporary grading policy for the remainder of the school year. Director Ariel Dolowich will present an overview and recommendation. Background: On March 13, 2020, the Newark Unified School District took action to suspend in class instruction due to the pandemic- COVID-19. On March 17, 2020, students began learning through distance learning. The Educational Services Department began working with teachers, administrators and our Labor President to review and plan for distance learning. Today's presentation will share the background and process, along with staff recommendation that follows the direction from the California Department of Education, the UC-CSU university system, private colleges and the community college system. For the elementary level, staff recommends, no grades for the third trimester and a teacher narrative/comments to inform the next grade level and for secondary credit/no credit.

Background: Classified employees continue to provide valuable services to support the district mission to ensure success for all students. The valuable contributions of our dedicated classified support staff have a broad impact on students, classrooms, offices, maintenance, grounds, cafeterias, and other support areas. This year, the week of May 17-23 has been designated as Classified Employees Week. Classified employees provide support to both students and staff in the Newark Unified School District. Students, teachers, administrators and the Board of Education appreciate their efforts. Resolution No. 2068 acknowledges the contributions of the District's classified employees.

Action Construction Management services.
Purpose: To approve the agreement with RGM Kramer, Inc. (RGMK), for project and construction management services for the Measure G bond projects.
Background: The Board approved an updated list of priority spending for Measure G projects including project and construction management services, at the February 20, 2020 meeting. Staff sent out informal requests for proposals and received two proposals for project and construction management services. In accordance with Government Code 4526, staff recommends approval of the agreement with RGM Kramer, Inc., on the basis of demonstrated competence and on the professional qualifications necessary for the satisfactory performance of the services required. The Statement of Qualifications from RGMK is attached to the agreement.
The attached agreement was reviewed by legal counsel.
"Phase 1" of the agreement is for planning services to assist the District plan for the development of several projects. Preliminary planning services shall include review of prioritized projects defined by the District, review of District budgets and other District information made available to better understand District goals and expectations, help in determining any architectural, engineering or other consultants that may be needed to develop projects and procure DSA and other regulatory approvals where required, determining how projects can be packaged, and establish a program outline and preliminary planning and construction schedule. The cost of Phase 1 should not exceed $20,000.
"Phase 2"- Construction Management Services. Upon completion of the Phase 1- Planning Services, Construction Manager shall develop a Fee Proposal for consultant selection, design oversight, bidding, construction administration and closeout services for district approval based on the projects and phasing approved by the District. These services may be presented and approved in a single fee proposal or incrementally by project pending completion of Phase 1 services and District direction.

Action with Newark Teachers Association
Purpose: The District and the Newark Teachers Association (NTA) reached a tentative agreement for 2019-2020, 2020- 2021 and 2021-2022. The NTA membership ratified the agreement by an 84% vote to approve on May 1, 2020, and it now comes before the Board of Education for ratification.
Background: The current Collective Bargaining Agreement with NTA sunset on June 30, 2019 resulting in both sides sunshining their reopeners for a successor agreement. Formal negotiations began on May 3, 2019. After several rounds of negotiations, we were able to reach a Tentative Agreement on February 19, 2020 for a three year agreement. The District submitted documentation to the Alameda County Office of Education (ACOE) indicating that the District can afford this agreement. ACOE has reviewed the documentation and agreed to our findings. NTA membership ratified the agreement by an 84% vote to approve on May 1, 2020. With the approval of the Tentative Agreement, the District was able to submit the AB1200 documents to ACOE. During the 2020-2021 and/or 2021-2022 school years, reopener negotiations may occur pursuant to section 13.1.2.2 (California Schools and Communities First Initiative contingency). 2021-2022 School Year, the parties mutually agree to reopen negotiations on up to two articles of each party's choice, provided, however, that no proposals shall be made on economic items or on any subjects that would increase District expenditures.

NTA members will receive the following compensation:
2019-2020 School Year: 1% increase retroactive to July 1, 2019. Effective February 1, 2020 all bargaining unit salary schedules shall be increased by an additional 1%. 2020-2021 School Year: Effective July 1, 2020 all bargaining unit salary schedules shall be increased by 1%. 2021-2022 School Year: Effective July 1, 2021 all bargaining unit salary schedules shall be increased by 1%. Effective February 1, 2022 all bargaining unit salary schedules shall be increased by an additional 1.5%. Attached are the AB1200 documents outlining the financial impact of the agreement.

Action agreement with California State University East Bay.
Purpose
The purpose of this item is for the Board of Education to approve the agreement for teaching experience commencing on April 9, 2020 and ending June 30, 2025 between California State University East Bay and Newark Unified School District.
Background The District works closely with local institutes of higher education (IHE) and supports school student teacher placements. Agreements between Newark Unified School District and a university must be in place before a student can be placed at a school site in the District.
Teachers, school psychologists, and counselors in training do fieldwork in our schools and are supervised by the administrators who volunteer to provide supervision and training.
Student teachers are able to learn, practice teaching, and fine-tune their craft under the direct supervision of a master teacher. The opportunity to student teach in the District benefits both the student and the District.
As vacancies become available in the district, it is invaluable to have the opportunity to observe directly new teachers who may be eligible to interview for vacancies and observe how well they fit into the culture of Newark.

Background: The warrant registers represent a complete listing of all payments made from District funds for a month. Because Newark Unified School District is a fiscally dependent District, each warrant must pass through two separate audits; first by the District's Fiscal Services department, and second by the County Office of Education. No warrant can be paid until such time as it is examined and approved by the County Office of Education.

Purpose: To provide Schilling Elementary students an onsite mental health clinician who will support Tier I and Tier II needs.
Background: This is the second Addendum for Health Clinician Jackie Melcher. We have attached her original contract as well as the newest addendum. The first addendum was increased by $5,784. This brought the amount to $62,784. The second addendum that is attached is being increased by $18,079.90. This brings the grand total of services to $80,863.90 for services at Schilling Elementary. Per the school site, funds were re-distributed to ensure the support during the stay in place order for students who need counseling. Funding is within the school allocation.

This is the first reading for the attached Board Policy. Pursuant to Labor Code 1034, as added by SB 142 (Ch. 720, Statutes of 2019), districts are mandated to develop policy regarding lactation accommodation. The district does not currently have a policy, and we are asking the Board to adopt one. The language is sanctioned by the California School Board Association. The administration has reviewed this document for accuracy and made revisions to reflect district practice.
If any revisions are recommended, the documents will be brought back to the Board of Education for a second reading.
