Meeting Resources
[5] SPEAKER_16: Okay, we're back from closed session.
[21] Ray Rodriguez: And before we report on what happened in closed session, Superintendent Sanchez has something that he'd like to share with our community. Go ahead, Superintendent.
[31] SPEAKER_08: Thank you, President Rodriguez. Ladies and gentlemen, members of the board. First of all, I would like to thank you for the opportunity that I've had to serve NUSD and the Newark community for the past four years. During my time in Newark, I've grown to know and appreciate the NUSD. That NUSD has a tremendously hardworking staff and a committed board of education and just excellent students. With great respect for our school board and the Newark community, I wanted to inform you that I am resigning my position as superintendent, effective June 30th, 2020, in order to pursue another opportunity. This will allow our Board of Education to begin the superintendent search process much earlier and also allow for a superintendent search during prime hiring season. I will be working closely with the board team to ensure a smooth transition for the remainder of the school year and look forward to seeing NUSD continue to improve as they continue to move forward.
[85] Ray Rodriguez: Thank you. During closed session, We did discuss public point discipline. Conference with labor negotiator concerning NTA and CSCA are negotiations. Conference with legal counsel regarding anticipated litigation and conference with legal counsel regarding assisting litigation and the numbers are in there. Public employee appointment, that's going to be, that's under your tender, right, Jessica? The appointment, yes. The appointment, right. And then the expulsion, we discussed, and we'll vote on it toward the end of the meeting. As far as the transition, Superintendent, I wanted to say, I happened to be president when you came on, and being in a new state and new area, coming from Colorado, and at that time, the board, you know, asked me to help with the transition and with your first year. And you came in at a very tough time for us. We were in deficit spending, as we have been for a while. And the budget was upside down. And naturally, there's the hiring process. When we lose one superintendent, there's position to be filled and everything. And I felt that you handled all that professionally. And you didn't, you could have easily said, Now that I know what's going on here, that I'll look for employment somewhere else, but you didn't. And you just went with it. And it's been a very tough four years. And I wish you all the best. And I know we're going to be in a transition period. So I intend to meet with the superintendent tomorrow and with Associate Superintendent Salinas and talk about the transition. And we've asked Member Martinez and Member Gutierrez to meet with superintendent and come up with a way that he can help us as we go through the transition. And the second meeting of December, we're probably going to be interviewing different firms that help with the selection of the superintendent. And we've done this before. And the norm for a superintendent in our area normally is four to five years. We wish you had stayed longer, but we're happy that you're going to stay with us and help us with the transition. In December meeting, we'll interview the firms. We'll choose one. And then starting in January, then we'll start the whole process, which normally takes three or four months for the selection of a new superintendent. Bowen, did you want to say something?
[272] Bowen Zhang: Yeah, I just want to thank the superintendent for your services in the district in the past four years. Thank you for your emphasis on equity and inclusion, and I look forward to working with you to make sure the transition is as smooth as possible. Thank you. Thank you. Member Nguyen.
[287] Phuong Nguyen: I just wanted to say thank you for helping me, onboarding me onto this board and through the transition, and I just wanted to say thank you to you for doing a great job so far.
[305] Ray Rodriguez: Thank you. Okay, so. The recognitions and celebrations will be returning in January of 2020. Now we have public comment on non-agenda item 7.1. Do we have anyone? Ms. Aquino. Okay, having none, we move to superintendent's report. Superintendent.
[335] SPEAKER_08: All right, thank you again and just as I, before I begin, I do want to also thank the board for professionalism and I think that it's great that we're doing this in an amicable way and I look forward to continuing that to finish the year strong and I do want Newark to do great. I look forward to seeing that in the future, so I'm really optimistic. for what you guys have on the horizon. Thank you for saying that. Thank you. Absolutely. I have just a couple of items for the board this evening. The first one is my nagging reminder about we have confirmed a new beginnings board training and parliamentary procedure training Friday, December 20th from 9 AM to 2 PM. Once again, Friday, December 20th from 9 to 2 PM. This is facilitated by CSBA Deb Dudley, who will be contacting each of you prior to the training. What she'll do when she contacts you is just kind of get a feel for what you want to get out of the training, what are the types of contents you want in the training. And then she'll shape the training after she speaks to every board member, and it'll be customized to what you guys want. So that's exciting that that's coming up. I know you guys have been asking for that, especially members Martinez and Gutierrez. So mark your calendars. I know Shara's been sending out reminders, but I wanted to remind you again. The second item is that Godby, the bond survey consultants that we've selected, would like to have a subcommittee of no more than two board members and any others from the district wishes to be involved in the survey process, but preferably not more than five altogether from the district plus two board members so that they can be part of this committee that they're going to run a relative to bond parcel tax survey committee. So just think about that if you're interested. And I know some members might be watching from home or maybe not, but just we'll remind them as well. So if you're interested in that, please let Char know and we'll get your names to the first two to get their name and we'll be on the committee. Okay. Um, that's all I have at this time. There's no juice.
[463] Ray Rodriguez: So would just to remind what either to remind or bring everybody up to date. Um, when you go through a transition and naturally, um, it's important for the superintendent and the associate superintendent to kind of work together. We want to make sure that, and I know Ms. Lopez put this up to me when she came in to talk to me as far as making sure that the things that we're doing continue and that nothing, you know, is stopped or just because Superintendent Sanchez, you know, would be in his last, let's say, six months. And then also, we've got difficult times ahead of us in talking about the bond and different things, school closure. So you can rest assured that the board is planning to make sure that as we move forward, we have people in place to help us with all these different things, including the superintendent who's going to be here through June. OK, staff report. Associate Superintendent Salinas.
[539] SPEAKER_26: Yes, good evening. As Ms. Aquino brings up the PowerPoint, we have an update for you as it relates to our dual immersion planning and some of the work that we've now embarked on. So I want to give a little bit of context. As you know, on the left-hand side, we have our strategic imperatives. And these are the board imperatives that were brought forward over the last two years, where we look at imperative one, academic excellence via equity and opportunities for all of our students, and also, two, that we're going to increase our enrollment. On the right-hand side are the California's eight state priorities. And if you're familiar with our LCAP and a lot of the work that we do as a district and every district in California, we really look at these eight priorities as we outline our work. So I wanted to give a little background, especially for our board members who are new or folks that are learning about this. Back in 2018, we updated some board policies. And one of the board policies that we updated was programs for English learners. And with that update, we were able to bring on board some new specialized programs that meet the needs of our students. At that time, we also did an update on the EL roadmap, the English learner roadmap that really speaks to the best programs for educating English learners, but again, also capitalizing on what do we do for all of our students so we can offer some specialized programs for all students. Going on to Our planning, as you know, we had at that time a committee that looked at how do we increase our revenue. And a lot of the talk was around increasing our enrollment and bringing on board some specialized programs to attract students into the district. Continuing with updating our awards policy, and that's the seal of biliteracy, which is essentially a new thing that we're gonna be looking at for this year, where students who graduate from our high school, who are fluent and bilingual in any language, in addition to English, will be able to have a seal from the state of California on their diploma. And then we had some updates in spring with the English Learner Roadmap. And at that time, we spoke to you about some of the program options we have with SEAL. And that is, again, enhancing the work we're doing at our Title I schools. We also had a lot of parent feedback. as to how do we optimize dual language immersion for students. And we also did a review of resources and really focused on Schilling Elementary as a school that's close to Area 3, but at the same time also has a lot of English learners, so we could attract some native English speakers to augment enrollment. So I wanted to provide a little bit of an overview. So working with Schilling Elementary, the principal, Dr. Wendy Castaneda-Leal, went ahead and conducted a survey for parents asking about programs. What kinds of things would they like to see at their school? Dual immersion came up. But then what language would they like to see? And overwhelmingly, the target language for dual language immersion program was selecting and focusing on Spanish, which is quite natural knowing the composition of the school and the students that we already have and how do we better serve them. We also looked at our teachers and our principal who began to do some research and also partnered with me and with some members of educational services as they started to learn more about what does it mean to be a dual immersion strand within a school. So at that time, we had teachers last summer who, with Dr. Leal, attended trainings for the, I guess I would say the capstone program of dual language immersion, which is the DLI workshops over the summer. In the fall, Dr. Castaneda-Leal did some presentations with her staff and also had very open discussions about what that could look like at Schilling Elementary. And we continue to look at looking at models and resources. This past couple of weeks, we had an opportunity to take a team of teachers and the principal to visit a 50-50 model in a neighboring school district to see what does that look like to the day-to-day. So we actually saw teachers in action teaching dual language immersion. And then we also had meetings with student services because we knew that it's not just about the pedagogy and the curriculum, but we also need to prepare for the operation side of it. What are the forms? What's the timeline? How do we get applications out to families who want their students to learn Spanish as a second language in a dual immersion setting? So we looked at some program models. And so what we looked at was this, was that after looking at the research and seeing where we have seen optimal results, that a 50-50 program model would be something that would be something that's strong for our students. And essentially it is that half of the day is in English and the other half of the day is in Spanish. Students would look at, we would have a composition of a classroom where a third of the students would be English learners. A third of the students are learning Spanish as a second language, which means they're native English speakers. And then a third of the population may speak another language at home or may be initially fluent. And we looked at how this could really bridge the cross-cultural understandings and developing of high academic achievement in both the first language, if it's English or if it's Spanish, and the second language, the reverse. So what we looked at in terms of goals was that we wanted to support a school-wide academic enrichment. A dual-language immersion cannot start school-wide. It is essentially a strand within a school. So what we're looking at is that this would begin at kindergarten and first grade, but then the question is how do we support the whole school to get some benefit of this? And so what the staff is starting to look at is how we could do school-wide assemblies for cross-cultural understanding, how we would build an after-school Spanish enrichment program for all students, whether or not they are in the kindergarten or first grade, so that all teachers get access, all students get access, even if it is a strand within the school. Essentially, what happens is that year one, kindergarten and first grade are the first to have it, and then that strand grows throughout the school. It still leaves English-only classes as an option, because not all parents may want this option, but it essentially becomes, as I said, a strand within the school. So, and I'm looking at how this printed out, but essentially we would work with the Schilling Elementary staff on curriculum pedagogy. These are essentially our next steps. We would continue to develop all the forms and applications and make sure that the website is up and running. Because if we are looking at a 2021 implementation, a lot of this work and the parent information sessions will start in January. And we would also look at ensuring that all of our board policies and AR's administrative regulations that support the program are already adopted and updated. Later on tonight, you're going to see at the first reading of some of the board policies for intra and inter-district transfers. It speaks to specialized programs, which is why we're bringing those forward tonight to start to get ready for this. We would look at continuing with supporting the planning and implementation of family and parent recruiting events. We want our parents to be able to really know what it looks like, to have very open conversations with teachers and with the principal and with our team, with Ed Services, as to what would the program model look like. Our principal, Dr. Cassandra Leal, is going to be reaching out and has already got some feelers out to work with MCA to begin to develop a recruiting brochure and videos for families that we would have available. And then again, we need to continue to work with our labor partners. So I had a very beginning meeting with NTA and with human resources, because as you can imagine, then there's staffing implications. So we want to be sure that all staffers are aware of this and that there is an opportunity to participate as a teacher in a dual language immersion strand. And we would meet with teachers to really review what are their professional development needs and what do they need as support. So I'm open for questions, but this was a very brief update. We look forward to sharing more. We're hoping our webpage will be up and running. The target for implementation of this strand is for fall of 2021. and we really see how this will be something to attract and increase our enrollment for Newark Unified, ensuring that at Schilling we will have a community that we're going to build on their success. It's already a very dynamic community, a very active community, and we want to make sure that we build on that success and really expand to more students and bring in more students to Newark Unified. Thank you.
[1112] Phuong Nguyen: So if it's successful, will there be another site considered for dual immersion?
[1122] SPEAKER_26: Yes, absolutely. In my experience, I started with, in my past, I started a dual language immersion with Spanish, but it can be virtually any language. We want to have success with the strand, and then a year out, we can start to look at if there's another language. So, for example, in a neighboring district, we started with Spanish and then saw a big need for Mandarin. And at that point, we could really see what other languages out there. Absolutely. Thank you.
[1150] Ray Rodriguez: I have a question. Why can't we start this right away? How come it's got to wait until 2021?
[1157] SPEAKER_26: Essentially, it takes about half a year to plan. We want to make sure that the staff is we want to make sure that our students are aware of what's what are going to be the commitments and and how we can support the staff to do this. Also with board policies for policies have to be updated. So for example, when we look at Schilling elementary. We want to make sure that priorities for Schilling students, siblings, kids within the district, but then also outside of the As it starts to grow, we can certainly stagger and start the next phase. I know that about a year ago, we also had interest around IB or around some other kind of specialized program. But that certainly would be something we can update and bring back.
[1212] Ray Rodriguez: And have we identified any families of students that are going, for instance, to Fremont Unified because we don't have this in place right now?
[1224] SPEAKER_26: That would be our next step. Right now, we want to be able to develop the web page to have that ready and the actual application. We will do a parent information night that we will highly publicize, certainly reach out to families that have left. But we want to be able to have a fair opportunity for all to apply at the same time. So it'll be kind of like a grand release. And then we start to take in the applications because we envision and we hope that there will be a priority list and start to really see what the need is. Right.
[1261] Ray Rodriguez: So to piggyback a little bit on Member Nguyen's, as far as other schools. So what happens if we have kids at other schools that want to transfer their children to Schilling? you know, in order to be in this. We might have a whole bunch, so how are we going to handle that?
[1283] SPEAKER_26: So the process would be outlined in our board policy. So as I said, there first would be preference for kids within the school, and then it goes out to Newark Unified, and then it goes out to outside of the district. So there is a priority just to first serve our kids.
[1299] Ray Rodriguez: And then what would be the guideline that we would use if, for instance, we wanted to do Mandarin?
[1305] SPEAKER_26: So what we could do is start to do a survey to really see what is the other language. If I remember years, last year we had a parent community that was really looking at Arabic. We could send something out sooner than later and start to just get that feedback, especially as we're starting to look at the LCAP to really, as we're asking questions about the LCAP, we could also at the same time get some feedback around other languages. That at the same time, but it does take, amount of a few months at least a six month period to really start to plan and do it thoughtfully. Okay.
[1342] SPEAKER_16: Thank you.
[1343] Ray Rodriguez: Thank you very much. Is that it on your first staff report? Okay. And you'll keep us updated as all this goes on. Appreciate it. It's long overdue. I think we'll be talking about this forever and not only would involve Spanish but you know other languages whether it's Vietnamese or Or, you know, there's just such a need. I mean, we've always talked about how fortunate we are to live in a community that we used to say, I remember when my kids went to school, we used to say over 40 languages spoken at most of our sites. And yet, you know, it's just taken us too long to do this. But I appreciate and hopefully those will move forward quickly. Okay. Okay. Employee organizations, CSCA. Anyone? Anyone from NTA? And NEWMA. Okay, good. Old business. We have items 11.1, 11.2, which I'm pulling because Ms. Parks wants to speak on that. And if anyone wants to speak on any of these, just fill out one of the forms and get it to us. Or anything that's on the agenda. Did I miss something? Hold on. No, the public comment on non-agenda items, where is that?
[1447] Phuong Nguyen: It's number seven. Already passed. This came in late, so if you want to allow this person to speak.
[1456] Ray Rodriguez: Yeah. Ms. Lopez, do you want to come up? I know we've already gone past that, public comment on non-agenda items.
[1469] SPEAKER_28: Hi, hi. Good evening, dear board members. And we're hearing some of the moms that have worked really hard throughout the last few years trying to help in the district and to work together to improve everything for our kids here in Newark. We wanted to basically say thank you, Mr. Sanchez, for all your hard work. We know it was a challenge, and we really appreciate everything you've done. For the first time in many years, we felt like we were heard, you know, as we are called the underserved community. So thank you very much for everything. So a lot of feelings here. I'm happy because We know that health is first, you know, especially when there's toxic environments. And also sad, sad because we know that this is happening again and again. We lost our past superintendent, our dear Dr. Markin, because the same thing happened. We just would like to tell the new board members that history is very important and you need to know more of the history that is behind everything that is happening in our district with our community. And I'm talking to the community in general. So we'll appreciate. We're very open to talk to you and to really make changes. We'd like you to take the decisions based on your own criteria. And please see a little bit of the background and the history that has been happening here in Newark, because we don't want this to happen again. We know that every time that we lose a good superintendent, a lot of changes come up, a lot of things have to, a lot of other changes in the way and really the students are the ones that get affected the most. So we really want you to pay attention to every step and every decision that you make after this. So we love to talk to you anytime. Please be open and we're very happy that Four new fresh ideas and minds are there together, and we're going to support you to make the changes. So thank you very much. Thank you all. Thank you.
[1610] SPEAKER_16: Thank you.
[1613] Ray Rodriguez: Hiring a superintendent, it's the most important thing that our board does. And we have a new board other than myself. And I'm going to try my best to help, along with Superintendent Sanchez to make sure that the new board gets up to date on all that's involved in the whole process and making sure that we choose the right person for Newark Unified School District. Okay, all business 11.1. Board policy 9322, agenda, meeting materials, second reading. So we need to vote on this. And staff recommends the board approve as presented with recommended revisions. And this is the CSPA template, and we're following their guidance on this. Anybody want to talk on this one? If not, we need a motion and a second.
[1678] Bowen Zhang: I move that we approve the new board policy 9322.
[1686] Ray Rodriguez: Okay, 11.1. Member John moves. I need a second.
[1690] Phuong Nguyen: I second.
[1691] Ray Rodriguez: Member Nguyen. Please vote. Motion passes unanimously with the three board members that are here and the student board member. Cesar, why don't you tell me that I need to ask you first? OK. I forgot.
[1717] SPEAKER_14: We'll get it right. OK.
[1718] Ray Rodriguez: Go ahead.
[1719] Phuong Nguyen: He's on vacation mode.
[1722] Ray Rodriguez: You can share if you want to share on this particular item.
[1727] SPEAKER_05: On this one, nothing to comment on. OK.
[1731] Ray Rodriguez: So we have four ayes. Member Martinez and Gutierrez absent. Thank you. OK. 11.2, before we discuss that, Ms. Parks. And then Cesar.
[1750] Cindy Parks: Good evening. Hi. Hi. Now I have the printed page, so I don't know what you all are looking at. But after you have the minutes and recordings, there's two paragraphs. And then it says, the minutes of the board meeting shall include, but not limited to, and there's a colon. Then there's a box, and then on my page 2, it says the superintendent or designee shall distribute a copy of the unapproved minutes. But I think that paragraph was supposed to be removed, because then you have a number 1, number 2, number 3, number 4, which would follow the colon. It would make more sense. So I think that that was supposed to be removed.
[1793] Ray Rodriguez: OK, so this is a second reading. Superintendent, anybody want to? address this? As far as... It's right below the box.
[1805] Cindy Parks: The first box.
[1806] SPEAKER_08: We can make those corrections and bring it back for a third reading.
[1810] Ray Rodriguez: Okay. Is that okay? Okay.
[1811] SPEAKER_08: I don't think there's an urgency to approve this tonight, is there?
[1818] Ray Rodriguez: Okay. Thank you, Ms. Parks. So we're bringing it back at the... So we're pulling that item then? Yeah, we'll pull that item.
[1824] Bowen Zhang: Shaw, would you... Are you okay with it, Board? Yeah. I have one more point.
[1828] SPEAKER_14: Go ahead, you have a question.
[1829] Bowen Zhang: I think on the, there might be, I think there's a, maybe it's a typo, maybe it's a grammatical error. So, that same page, second page, a brief summary of the board's discussion on each agenda topic, rather than a verbatim record of each board member's, I think there should be apostrophe between member and DS, because that's not board members' specific points of view during discussion. Where are you looking?
[1853] Ray Rodriguez: Second page. Second page. Number two.
[1855] Bowen Zhang: You're talking, oh, down there. Number two. Each board member apostrophe as specific points of view, not just. And I guess I have.
[1865] SPEAKER_05: Yeah, no, no.
[1866] Bowen Zhang: I guess I have, I also get a question regarding the 30 day erasure. So after 30 days, the recording may be erased or destroyed. But what happens after 30 days is if a member of the public asks for a public record request, how do we recover that one? Mr. Kino?
[1887] SPEAKER_21: We will currently to we have it it's available on the YouTube, but we have physical discs And if someone needs that we have records going back for years Okay, then what is that 30-day?
[1899] Bowen Zhang: Like we made third.
[1901] SPEAKER_21: I believe the 30 days is the CSBA requirement What are we required to do? But we as a district have them and at any time if we have a Records Act or something we have the CDs to be able to provide that so we actually don't erase after 30 days and I have the desk so I do not erase anything.
[1920] SPEAKER_05: I also have one thing that I would like to comment on on this specific item. So obviously at the last Wednesday special meeting, you know it was a special meeting and as a result it wasn't broadcast so I think that you know there should be some provision in this specific board policy that we make that the board make a good faith effort and I know Char wasn't here to Administer the recording at that time, but I do think it is in line with The board's goal to transparent or the board's goal of transparency that we make an attempt to broadcast as much as possible So yeah, that's I would prefer that to be considered.
[1963] SPEAKER_21: Okay, mr. Kino Yes, and I appreciate your thoughts on that as well to be specific perfectly clear actually Brown Act We are not governed by Brown Act to actually record meetings. That is a district choice to do. The other thing that we have to keep in mind for our district, we don't have an in-house person to do this. So we share the person we use with the city and other organizations. So when we call last minute special meetings, he is not available at our disposal. And we do do everything we can to record, but again, governed by Brown Act to record meetings. Again, we choose as a district to do that.
[2003] Ray Rodriguez: So I think what, not to put words in his mouth, but it seems like Cesar's asking that we do everything possible.
[2009] SPEAKER_21: And absolutely. And we do. And Duke tries to get here when he can. And like I said, we wanted to be known that he's not just our person, so we're sharing him. So even when we moved our meetings from Tuesdays to Thursdays, we had to make sure it's on the off weeks of the city meetings in which he films as well. So we will make every effort. And when we can, if we can't, video, we will try to voice record as well. And that's something that, unfortunately, I wasn't here to do last week. But we will make every effort, and we try to.
[2036] SPEAKER_05: OK. Thank you for clarifying.
[2037] SPEAKER_21: Sure. Oh, absolutely.
[2039] Ray Rodriguez: Thank you. 11.3, board policy 9323.2, actions by the board, second reading. Cesar, did you want to address this one? Before we vote Okay, so it's open for voting I need a Motion in a second for eleven point three board policy nine three two three point two I move that we approve board policy nine three two three point two as presented. Okay member John I second member Nguyen seconds, please vote How does that work? Hold on a second. Let me clear this. Okay. So we open for voting. And okay. So your vote is in. That's okay. Okay, so now everybody else votes.
[2124] SPEAKER_14: All right.
[2126] Ray Rodriguez: Okay. Motion passes, four ayes and two board members are absent. 11.4. Board policy 9321, closed session, second reading.
[2151] Bowen Zhang: Go ahead. I got a question regarding the negotiation with regard to real properties. I remember in the paragraph it was saying appointing a negotiator for real properties is about purchase, renting, lease, or exchange. I guess is this only limited to these four items or any negotiation with regard to real properties?
[2181] SPEAKER_08: As far as my understanding, it is relative to any negotiation even of considering sale of property can be done in closed session.
[2195] SPEAKER_14: OK.
[2196] Ray Rodriguez: OK. Open for boarding. Student member Castillo.
[2207] SPEAKER_05: There is not a. Hold on. Oh. We have to move.
[2211] Ray Rodriguez: Okay point I need a motion in a second.
[2215] SPEAKER_05: Oh Yeah, I am on page 7. I believe after this blue box with real property negotiation There's a typo I It says the board I'm quoting the document says the board made me in closed session with the it's real property negotiator prior to the purchase So I guess just make sure that that gets corrected If by some obscure law, that gets us into trouble.
[2247] SPEAKER_14: So we can.
[2247] Ray Rodriguez: Yeah, just that typo. So the motion would be that we would move to either bring it back or we would move to move on it with the corrections.
[2257] SPEAKER_08: It's currently only first reading, I believe. Is that correct? No, it's second. It's second? I'm on the wrong one. I'm sorry. That's OK. So we can make that edit.
[2266] SPEAKER_21: If I may. So, you know, these are in your draft. These are the drafts. So, these are just suggested edits from CSBA. We will not publish them incorrectly. They'll be clean copies. So, some of the grammaticals that you may see are not to be grammatical. It's showing you the actual change CSBA. For example, making a small case, T to a capital T. They have us show you everything. So I appreciate the feedback. We will clean them up, but I don't want you to think that we send them off this way. This is just the editing to kind of show the differentiated of the changes and everything happening. So I just kind of wanted to make it clear how these come across.
[2310] SPEAKER_05: Because the way it's presented in the text, all of it is black, which I'm assuming that it means that that's previous board policy. So I don't know if that's been there, but I'm just pointing it out.
[2322] SPEAKER_21: And yes, these haven't been changed in years. So you're absolutely correct. So we're keeping an eye, and I do, again, the feedback is very much appreciated. I just really want everyone to understand the editing piece to this and all the different pieces that have to come together. And you're seeing it all. So I just kind of want to make sure everybody knew that.
[2339] Ray Rodriguez: So we can make a motion to approve with corrections.
[2345] Bowen Zhang: I move that we approve board policy 9321. Member Jean?
[2350] Ray Rodriguez: I second. Member Nguyen seconds. Student board member Castillo?
[2365] SPEAKER_16: Hold on.
[2366] SPEAKER_05: Mine should be in.
[2368] SPEAKER_33: Yeah.
[2374] Phuong Nguyen: We can't vote.
[2376] SPEAKER_14: Okay.
[2377] Ray Rodriguez: We're okay? Okay. So, let's see. I'm still trying to learn how to do this thing. Okay. Everybody else votes, please? Yeah. We did it. Okay. Motion passes four ayes with member Gutierrez and Martinez absent. Okay. New business. Again, board policy. Now, these are first readings. So we normally ask that we discuss any editing at this point so it can be, when it's brought back, it's ready to be voted on, accepted. So anything on 12.1?
[2425] Bowen Zhang: I just have a suggestion. When I read this document, I understand this is not a complete document. because you're just showing the part that we're either removing or adding or modifying. I just hope maybe the complete document will show the parents exactly how the priority list set when you are trying to opt for a school beyond your attendance area.
[2447] SPEAKER_26: Yes. So if you look at the top right-hand corner of the document, years ago I know that the board had asked for this type of, I guess, a legend where it would tell you what we're deleting, what we're not. The blue information, that will be deleted, but we want you to be aware of it. If you are suggesting to have maybe more clarity in terms of just priority, I could take some suggestions now and try to make that clearer.
[2473] Bowen Zhang: Yeah, because by reading this document, it gives me a feel that if, say, a school is oversubscribed and we have this lottery, and if an applicant turns in the application late, he will be put onto the wait list and wait for the next lottery, right? During the first round of lottery where everybody applies in time and then we do this because of oversubscription, we do this lottery. Say some student will not win the lottery, then what will happen to them? They will need to apply again to be put into the wait list. And when they were put on the wait list, are they in front of the person that turned in the application late or they're behind it? Yeah, I think that.
[2516] SPEAKER_26: I'm going to ask Ms. Leon to speak a little bit about that and give us some clarity.
[2522] SPEAKER_27: Is this on? Hi. Good evening, everybody. So to answer your question, yes. So if we have more applicants than spaces, we do a lottery. And so we start pulling numbers. And so the first number we pull, they're number one. And correct me if I'm wrong. And then they go number two, number three. So this lottery comes after everybody else that applies late. So everybody in that list is going to come before anybody else that applies after the deadline. Is that clear?
[2562] Bowen Zhang: So what will happen to the student applicant that does not win the lottery?
[2567] SPEAKER_27: So the one that's on the waiting list, they're at their home school. Or if we decide that they want to go to Schilling, and there's space at Schilling, we might decide to do that. Is that clear? They'll go to their home school.
[2586] Bowen Zhang: So I guess what I didn't quite understand is, say we have five openings, and then 10 people submit their application in time for lottery. After that, there are, say, two more submitted. So the two more submitted late, they will be put on the wait list, right? And then the 10 participate, the 10 students participate in the lottery of five. Final one win and final one lose, right? And the five that lose, if they want to apply to transfer to that school again, they will be put into a waiting list behind the two that submit late, right? Is that correct?
[2616] SPEAKER_27: Yes.
[2617] Bowen Zhang: Okay.
[2617] SPEAKER_27: Yes. And so also if somebody moves that's in the program, if somebody moves, we go to the top person that's on the waiting list and we call them to come to the program.
[2627] Bowen Zhang: Yeah, that's what I feel like because sometimes If you are unlucky, you might apply early, but get in later than someone that applied late, right? And another thing I want to ask is, if you have, say, a new development coming in, and then you are in, say, school A attendance area, you are supposed to go to school A, and school A has full capacity due to whatever, due to we have intra-district transfer students. What will happen to that new student that just moved into our city? You'll be going to another school, or you will be?
[2662] SPEAKER_27: So usually we give priority to the people that live in that attendance area. Usually that's how we do it.
[2669] Bowen Zhang: Because on the board policy also says if you apply for a transfer, you win the lottery. You don't need to reapply. So if in the case of you have 100% capacity, next year you have one new person moving into the district of attendance, and the school is full. So somebody will need to be kicked out of the school for the new person to get into the school, right?
[2694] SPEAKER_27: I see what you're saying.
[2695] Bowen Zhang: So that means there will be some people that might need to reapply. If they win the lottery in first year, that's possible, right?
[2705] SPEAKER_27: I don't think I'm understanding.
[2707] Bowen Zhang: No, what I'm saying is, again, that school, five openings and 10 applicants, let's say five of them win. In that year, you have 100% capacity, right? You have five people outside of the attendance area attending the school. Come next year, you have one new student who just moved into the city and lives in that school attendance area. So since we gave priority to this student, so he will be going to the school. then that means there will be one person being kicked out of the school, right? Given the school is already at 100% capacity.
[2740] SPEAKER_26: So what we do is that we also have to follow Ed Code and with the board policy. So that essentially then becomes the homeschool for the student. But we also carry a list of the kids that it's not their homeschool, but we have a list. So as we're building capacity for the following year, We are aware of that and we look at how we can leave room for a neighborhood school student who may move in over the summer. And so we try to ensure that there's capacity. As you remember the conversations about overflowing students and last one in, first one out, we would still continue to keep that list. But what I'm hearing from you is that although we're updating the board policy, On the website, we need to have just a clearer way of the rules so that parents are able to not have to dig through a document like this. So what we could do is on the website that we have for enrollment, put some very clear direction. If you're there by intradistrict, these are the rules. If you're there by intradistrict, these are the rules. We can do that parent-friendly.
[2804] Bowen Zhang: Yeah, because by reading a document regarding applying to intradistrict transfer, the sentence really is, it's better to be late than unlucky.
[2816] Ray Rodriguez: I have a suggestion. Both of these policies, this has been contention, this has been an area of need for a while, that we have a very clear policy. I had a gentleman a couple of years ago that bought his house right across the street from one of our schools, and he had a second grader, and he was told that You know, it was fall. And he wanted us to go through all the students and have the students leave, because even though they had been there a couple of years, he wanted his student, naturally, because he lives across the street. So because there's so many questions, and this is such an important issue, because we want to make sure that we're fair to everybody, and we do have grandfathered in, do we still do that? Where if a student's been there, even though they don't live in the school boundary, they get to stay?
[2882] SPEAKER_26: Right, but that's our ed code, so yes, so that's what we have to follow.
[2885] Ray Rodriguez: Okay, so maybe this will be, before we adopt these, maybe have a study session on these. To me, it's so important that the board is clear, especially since we have a new board, on making sure that that everything flows so that our parents feel that, you know, they're not going from one place. They go to one school to apply, and then all the district office. You know, so we cover the whole spectrum of things.
[2915] SPEAKER_26: We could. My only, you know, as I shared in the previous presentation, we are hoping to unveil the recruitment efforts for the dual immersion in January. So we would have to have the study session bumped up sooner than later in December in order to do that. What I could do is these come back for second reading for December 5th, and then at that time perhaps bring some parent-friendly attachments that are not part of the board policy, but to share it with you all. And then I know we were looking at study sessions, and I think we were looking at later than January for that. That's my only constraint. And I think we were looking at a study session on December 5th to look at the counselors, And then in February is when we were looking at the enrollment process January restorative justice and so we would have to reorder that but unfortunately I am under a constraint with because of the dual immersion to get that done by January.
[2982] Ray Rodriguez: Okay, so What do we have for our next two board meetings for our study sessions?
[2987] SPEAKER_26: So what I see here is for December 5th is the counselors. For December 19th, we were looking at Measure G. January, restorative justice. And February, enrollment.
[3000] Ray Rodriguez: OK. So maybe the second meeting? I think this would take preference over that, I would think.
[3007] SPEAKER_26: For December 5th?
[3009] Ray Rodriguez: No. She's been asking. Let me talk to Member Martinez, and then I'll get back to you. But I just think having a study session and then having the item back for action would be something that would benefit the board.
[3021] SPEAKER_26: And our only constraint would be that we have a January unveiling of the application.
[3025] Ray Rodriguez: So we need to do it sooner than later. Yeah. Understand. OK, so both of these.
[3030] Phuong Nguyen: I just have a quick comment. Go ahead. So to go back to what Member Zhang was talking about, so is there Is there a way for us to take out the language for kids who are in the lottery? If they don't get a position based on the lottery that they are put in, can they be on the wait list above the kids who applied late?
[3057] SPEAKER_27: They actually are. All the kids that are in the lottery, they're the ones that are not making it because there's no room at the school. So they're the ones on the list. And they're at the top of the list. Everybody else that applies late, they come under that, after that.
[3073] Phuong Nguyen: OK. So just the wording just needs to be clear. OK. OK. Thank you.
[3078] SPEAKER_27: Thank you.
[3080] Ray Rodriguez: Thank you. So 12.1 and 12.2 we'll bring back, if that's OK with the board. OK. 12.3, resolution in support of census 2020. Yes.
[3099] SPEAKER_26: So good evening. As you know, Census 2020 is right around the corner and we are in a great partnership with the Alameda County Office of Education and also the California School Boards Association. So what we have before you is a resolution that is in support of Census 2020 and speaks to just the effort that we need every person counted in Newark. Because what that has on the other end, one, recognition of the number of families and kids and adults that we have in Newark. But also, as you know, that there's funding tied to it. So every person must be counted, every person counts. And so this is a resolution in support of it. The Alameda County Office of Education is gonna partner with us to ensure that we get the information out. I know the city of Newark is also making an effort on their part. So we bring forward this resolution for your approval.
[3156] Ray Rodriguez: OK. Discussion? Motion and second, please.
[3162] Bowen Zhang: I move that we approve Resolution 2052 regarding Census 2020. OK.
[3168] Ray Rodriguez: I'll second. Mr. Castillo? Vote or discussion? Clyde, did you want to let me open for voting? Did you want to add anything to it before you vote?
[3184] SPEAKER_05: No. I mean, the census is something that obviously influences. It may seem like a very abstract concept, but it has a variety of influences on our daily lives. And it is important for every family, and not just Newark or not just in Alameda County or in California, but in the entire United States. to respond to the census and to be able to respond to the census free from any sort of discrimination or retaliation because it is the foundation for our democracy. It is the foundation for this country and what you live. So, I am wholeheartedly behind this resolution. Thank you. Well said.
[3233] SPEAKER_16: Okay.
[3237] Ray Rodriguez: Everybody vote, please. Motion passes, four ayes. Member Martinez and Gutierrez absent. 13, consent agenda, 13.1, personnel report. Need a motion and a second. Discussion?
[3274] Bowen Zhang: I move that we approve 13.1.
[3277] Ray Rodriguez: Member John moves.
[3279] Phuong Nguyen: I second.
[3280] Ray Rodriguez: Member Nguyen seconds. OK, this is an item where the student member does not vote on, right? OK, so please vote. Motion passes, three ayes, with member Martinez-Gutierrez absent. Did you want to say anything on this? OK.
[3309] SPEAKER_18: Would you like me to? Mm-hmm. Good evening, members of the board and members of the audience. It's with great pleasure that I would like to announce the appointment of Mr. Long Vo to become our new network manager for the New World Unified School District.
[3338] Ray Rodriguez: Maybe he can come to the next meeting so we can... Thank you. 14.1, I mean 14, consent agenda, and we go through 14.1, non-curricular overnight athletic trip for Newark Memorial varsity softball to travel to Sparks, Nevada 14.2 warm report for October 2019 14.3 minutes of the regular board meeting November 7th 2019 and 14.4 minutes of the special board meeting November 13th 2019 anyone want to pull any one of these items I Just have a comment
[3387] Phuong Nguyen: I just have a comment on the warrant report. Is there any, oh, well, actually, Marie's not here.
[3396] SPEAKER_08: We'll take notes and ask her.
[3397] Phuong Nguyen: So if you could ask her on the warrant report, can we get more detail on contractual services and what exactly it is that we're paying for? OK.
[3413] Phuong Nguyen: Thank you.
[3414] SPEAKER_05: Yes. Member Gutierrez. Yes, I do have a comment on 14.3. The record of the people who spoke during public comment on non-agenda items, which is 9.1 on the second page. I don't know how important it is to record keeping, but some of the names are spelled incorrectly because I know them personally. These names are not correct. I don't know if it's important to correct them, but I just wanted to mention that.
[3448] SPEAKER_14: Mr. Kino?
[3449] SPEAKER_21: I am working off of the speaker cards, so I'm doing the best to transcribe so they may, I can go back in if there's students in Synergy, but if you could actually mark the ones for me, I will fix them and make them published correctly. Okay. Thank you very much. Okay.
[3467] Ray Rodriguez: So are you okay with that one with corrections, or did you want to bring it back?
[3471] SPEAKER_05: No, I'm okay with corrections. Okay.
[3474] Bowen Zhang: I move that we approve 14.1 to 14.4.
[3478] Ray Rodriguez: Member Jean moves.
[3480] Phuong Nguyen: I second.
[3481] Ray Rodriguez: Reminu in seconds. Member Castillo. Okay.
[3491] SPEAKER_14: Okay. Okay, everybody vote.
[3498] Ray Rodriguez: Okay, excellent. Motion passes four ayes with Member Gutierrez, Member Martinez not here. Okay, we have 15.1 on this one, just the board votes on the student expulsion. I need a motion and a second on this.
[3518] Bowen Zhang: I move to confirm the expulsion.
[3521] Ray Rodriguez: Okay, I second. Please vote. Okay, motion passes three ayes. Member Martinez, chair is absent. So as everybody knows, we have to have at least three board members have a quorum. If not, we don't have a meeting, OK? So I'm thankful that both of you are here so that we can move on with these important items. OK. OK, 16.1, Board of Education Committee Reports, Announcements, Request a brief and discussion. You want to go first, Cesar?
[3570] SPEAKER_05: Sure. So I have a few things to announce. The robotics team, in my last report, they went to Saratoga. I'm proud to announce they placed 14th out of 28 teams over there. So it was a good start to their season. I heard from their captain. They've definitely identified some not problems, but things that they have to work on with the robot, but it's shaping up to be a good season. Rocketry is going to do the first launch for all four teams. It's going to be this Saturday at 8 a.m. behind the Newark campus of Ohlone. We had two launches, or two teams launched last weekend. My team didn't, and one other team didn't. We didn't have our rockets prepared. But one team is very close to our goal. And that goal is supposed to be reached by April. So those teams are making good time on the challenge for this season. And I believe that, oh, we just started our canned food drive. ASB just started a canned food drive. So each third period class will be collecting cans. And the winner will be getting a pizza party. So we're hoping to get. We're hoping to get a lot of donations for the holiday season. That's it at this time. Thank you.
[3658] Ray Rodriguez: So how do we donate? You just give your money now?
[3661] SPEAKER_05: No, CanFood Drive. Oh.
[3664] Ray Rodriguez: CanFood Drive, yeah. So we don't give you money to buy CanFood.
[3667] SPEAKER_05: No, donate the CanFood, yeah. OK, good.
[3670] Ray Rodriguez: OK.
[3671] Phuong Nguyen: You have to bring it in.
[3672] Ray Rodriguez: We have to bring the CanFood. Got it. And where do we bring it to?
[3676] SPEAKER_05: You can bring it to the activities office inside the commons. OK. Thank you for doing that. Appreciate it.
[3685] Bowen Zhang: It was a ton of fun to go to Grand and Schilling for the ribbon-cutting event for the mini soccer pitches. Thanks for the generosity of Think Together and Target Corporation. I hope we can continue work with the local nonprofit and our generous corporate sponsors to bring more programs and more activity to the students in our district. Other than that, I just want to wish everyone a happy Thanksgiving weekend.
[3714] Phuong Nguyen: I just want to say thank you to staff for providing and getting the funding for those soccer fields for Graham and Schilling. That is a tremendous job that you guys did. And the kids love it. And also just wanted to wish everyone a happy Thanksgiving.
[3745] Ray Rodriguez: Thank you, Superintendent Sanchez, for being so kind as to, you know, as far as the agreement that we're going to have in helping us through the whole transition. And we look forward to any events that are going on. We want to make sure you're involved. And I know you and Associate Superintendent Salinas get along very well, so this should be pretty easy to move this forward. Again, I want to talk about the Community Engagement Committee, and hopefully we get people that want to be involved in that. And the ribbon-cutting, thank you, Owen, for mentioning that. It's very exciting. It's exciting when partnerships that we have and you know, what happens when people get together. We can do great things. The League of Volunteers love Newark. It's going to have their Thanksgiving feast for feeding the homeless on Thanksgiving Day at 12 noon at the Newark Pavilion. You're all welcome to come. And I want to thank all the young people, the leadership groups from all the schools, especially Newark Memorial, that work very hard during this time of year, and also Bridgepoint, and they also do, and also at the McGregor site, and the junior high school also. So all the students that are involved. I think it's so important to have students involved. I had the opportunity of taking my grandson to visit a person that I know that's homeless, and he's over when you get off the freeway. I'm on 84. His name is Bruce. He's in a wheelchair. And so I took Joaquin over there, and we gave him some cheeseburgers and some water and stuff. And so we got a chance to chat with them. There were two or three people there. And homeless come with so many different things, whether it's a Vietnam vet, or whether it's just someone that just likes being alone. I remember serving on an organization that was trying to find homes and jobs for homeless. And sometimes they just didn't want it. They just wanted you to help them for that particular day. And I know it's difficult for us that work with them. But anyway, Newark's always, especially our kids, our young people, have been involved in helping with the homeless. And that's a big issue for all communities right now. It's very big. Anyone else have anything? Okay. As far as any, you know, the futures, the only thing I have is, again, Associate Superintendent Salinas, it's the, and hopefully we can do something on the workshop for the transfers as soon as possible. We can do that. Okay.
[3950] SPEAKER_08: Thank you, President Rodriguez, members of the board, ladies and gentlemen. I do want to remind everyone listening and everyone here tonight that we will have a meet and greet for Newark Unified School District Special Education Department to meet the new special education director. That will be Thursday, December 5th in the morning from 830 to 930 a.m. in the here in the district training room behind you here. So we're trying to get that out for people to begin to meet her. December 5th, 8.30 to 9.30. I think the rest of her day has been pretty booked. So we'll probably do something else later in the evening. But for now, that's the first opportunity we had. But she's already hit the ground running, so.
[3996] Ray Rodriguez: OK. Sean, could you help me? I know that we get different emails on what's going on. And I know we have the culinary. And I forgot about to mention that one. Could you? I'll mention that. I have it on my menu. Can you?
[4009] SPEAKER_21: Yes, sir. Actually, I sent it today of all the events for the month of December to each of you. OK. Thank you. And you'll get calendar invites as well. But I sent you everything for every site. OK. But it didn't have the meet and greet. So I apologize for that.
[4021] SPEAKER_08: OK. No, that's fine. So, but Jenny, go ahead. So the second one, a few of the things I'm doing. One of them is tomorrow, a culinary class feast at Bridgepoint starting at noon. So if you want to join me there, please join me there. It should be great. Always having our kids do that is fantastic. I think the last thing was two more things. One is I do want to certainly thank all of our staff and students and hope they all have a well-deserved break next week. And I know our staff's been working hard. I think I see it in their eyes at meetings today. And they're just kind of tired and ready for some time off. And they certainly deserve that. I hope they have a great time off. But along those lines, I also want to remind people we're entering the holiday season, and this is a time to be very vigilant and look out for each other. We definitely see a spike in people being sad or people being upset. Holidays tend to bring out the emotion in people and dig up past wounds. So please keep an eye on things, and certainly on our students, for sure, but also on each other. I think that's really critical. So please do so. If you can, if you see something, say something, and make sure we get people help that they need. And last of all, I'd like to congratulate President Rodriguez for probably entering the meeting before 8.30. And I know the members Gutierrez and Martinez would be very jealous of that achievement tonight. So congratulations.
[4110] Ray Rodriguez: Thank you. And again, happy Thanksgiving to everybody. And it's 8.18, and the meeting's adjourned.
